Full Terms and Conditions

  1. Instructions on how to enter and this promotion form part of these terms and conditions (“Terms and Conditions”). Participation in this Spacetalk User Generated Content (“Promotion”) is deemed acceptance of these Terms and Conditions. This Promotion is not valid in conjunction with any other offer. Entries must comply with these Terms and Conditions to be valid.
  2. The promoter is Spacetalk Holdings Pty Ltd (ABN 64 606 733 804) of Level 2, 104 Frome Street, Adelaide SA 5000 (“Promoter” or “Spacetalk”).
  3. Entry into the Promotion commences at 12:00am (AEST) on 25th October 2024. Entry into the Promotion closes at 11:59pm (AEST) on 31st October 2024 (“Promotion Period”). The Promotion Period may be extended in the sole discretion of the Promoter. Entries received after the Promotion Period will not be accepted.

Entry Details

  1. During the Promotion Period entrants may submit one entry to the Promotion Instagram by:
  1. Uploading a photo of your kids enjoying their Spacetalk Loop or Spacetalk Adventurer 2 smartwatch on their personal Facebook or Instagram account;
  2. Tag @Spactalk_co in the photo;
  3. Click ‘Like’ on the official Spacetalk competition post; and
  4. Tag at least 1 friend in the comments of the official Spacetalk competition post.
  5. Entrants may share the official Spacetalk competition post to their Facebook or Instagram stories for an additional entry into the prize draw.

All valid entries received during the Promotion Period will be eligible, as set out below under Draw Details. Specific eligibility criteria are outlined in Eligibility below.

The Promoter will select a winner in accordance with the Draw Details below.

 

The Prize

  1. There is one (1) Prize to be won, comprising of:

 The winner will be awarded one (1) $500 spacetalk.co store credit in the form of a discount code emailed to the winner. 

Store credit valid until 31st December 2025.

 

 Draw Details


  1. Valid entries will be reviewed by a panel of judges appointed by Spacetalk at its absolute discretion. The panel will consider the entries and select one winner. The panel, selecting the winner may consider (but are not limited to) the following criteria: impact, story, creativity, presentation, consistency with Spacetalk values. Entries that display or encourage unsafe practices, as deemed by the panel, will be void. 

The winner will be determined at the end of the Promotion Period, as follows:


At a location deemed suitable between 9:00am and 10:00am ADST on 01st November 2024.



Notification of Winners

  1. The winner will be notified by direct message on social media by 5:30pm ADST on 01st November 2024.

 

Prize Claim Date

  1. Prize must be claimed by 5:30pm ADST on 01st December 2024.

 

Unclaimed Prize

  1. If the Prize remains unclaimed by the Prize Claim Date, the panel of judges will consider the remaining entries and select an additional winner. 

The supplementary winner will be determined at a premises deemed suitable between 9:00am and 10:00am ADST on 2nd December 2024.

 

Prize Delivery

  1. The Prize will either be emailed to the winner in the form of a discount code to the www.spacetalk.co website.

 

 Eligibility

  1. To be eligible to enter the Promotion, each entrant must:
  2. a)    be an Australian resident currently living in Australia residential and postal address;
  3. b)    be aged 18 years old or over;
  4. c)     not be an employee of the Promoter, of a Participating Retail Store or of any agency associated with this Promotion, or be an Immediate Family Member of such a person;
  5. d)    be the Participating Product’s end-user, meaning the entrant must Purchase the Participating Product for their own use and not for commercial purposes, re-sale, re-supply, rental, hire purchase or any other indirect use;
  6. e) follow the entry details listed in these terms and conditions.

The Promoter and its associated agencies accent no responsibility for lost, stolen, late, damaged or misdirected entries. Entrants must ensure that all personal details provided are correct.

 

Validation of Entries

  1. The Promoter will:
  2. c) ensure the entrant fulfils all requirements outlined in these terms and conditions.

Prize Restrictions

  1. The winner is responsible for redeeming the store credit on the spacetalk.co website. Any unused credit will be forfeited by the credit expiry date. 
  2. If the Gift or element of the Gift becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute the Gift or element of the Gift of equal or greater value at the Promoter’ sole discretion, subject to any written directions from the relevant authorities. Entrant’s will not be entitled to any additional compensation in the even that the Gift or element of the Gift has been substituted at equal or greater value.

 

Invalid Entries

  1. The Promoter may, at any time, verify the validity of entries and entrants (including an entrant’s or companion’s identity and age provided as part of an entry) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. All decisions of the Promoter are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  2. Incomplete, indecipherable or illegible entries will be deemed to be invalid. Entrants are responsible for ensuring their correct contact email address and other details are provided and any updated details are notified to the Promoter. The Promoter accepts no responsibility should an entrant fail to notify the Promoter of correct details or of a change to those details, or of otherwise providing incorrect information.

 

Privacy

  1. Entries remain the property of the Promoter. Spacetalk and its agents collect personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, offer suppliers and, as required, to Australian regulation authorities. Validity of entries is conditional on providing this information. Spacetalk and its agents may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning an entrant. Entrants acknowledge that the information they provide will be collected by or on behalf of Spacetalk and may be disclosed to other group companies and to third parties that help Spacetalk deliver its products and services (including suppliers, contractors, dealers, agents and business partners) or as required by law. Entrant’s should direct any request to access, update or correct information to Spacetalk’s privacy policy and by entering the Promotion, each entrant accepts the terms and conditions of Spacetalk’s privacy policy. General

 

  1. By entering this Promotion, an entrant consents to their name, image, location, content of their entry and any other information submitted to the Promoter being published in any form of media by the Promoter at any time, including but not limited utilisation of the entry social media post or image for future marketing or advertising by Spacetalk.

 

  1. Any costs associated with this Promotion and making an entry is the entrant’s responsibility. All taxes (excluding GST) which may be payable as a consequence of receiving the Prize is the sole responsibility of the entrant. All other ancillary costs including but not limited to insurance, taxes (excluding GST) and any and all other expenses are the responsibility of the entrant. The Promoter makes no guarantee of the availability of its web services and will not be held responsible for any interruption of service that may interfere with an entrant’s ability to participate in this Promotion.
  2. Subject to these Terms and Conditions and to the maximum extent permitted by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
  3. a)    any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
  4. b)    acts or omissions (including negligent acts or omissions) of the Promoter or its employees or agents involved in he conduct of this Promotion;
  5. c)     any theft, unauthorised access or third part interference;
  6. d)    any original Purchase documentation that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
  7. e)     any tax or other financial liability incurred by the entrant.
  8. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer rights under the Competition and Consumer Act 2020 Cth (“CCA”) or any other legislation that may not be excluded, restricted or modified by these Terms and Conditions. If the CCA or any other legislation implies a condition, warranty or term into the Terms and Conditions or provides statutory guarantees in connection with these Terms and Conditions, in respect of goods and services supplier (if any), the Promoter’s liability for breach of such a condition, warranty, or other term or guarantee is limited to (at the Promoter’s discretion), to the extend it is able to do so:
  9. a)    in the case of supply of goods, the Promoter doing one or more of the following:
  • replacing the goods or supplying equivalent goods;
  • repairing the goods;
  • paying the cost of replacing the goods or of acquiring equivalent goods; and/or
  • paying the cost of having the goods repaired; or
  1. b)    in the case of supply of services, the Promoter doing either or both of the following:
  • supplying the services again; and/or
  • paying the cost of having the services supplied again.
  1. These Terms and Conditions are governed by the laws of South Australia. Entrants submit to the non-exclusive jurisdiction of the courts of South Australia.
